The H-1B visa, the primary legal pathway through which skilled foreign professionals — disproportionately Indian nationals working in technology, engineering and related fields — obtain authorisation to work in the United States, has long been criticised by both employers and visa holders themselves for structural rigidities that tie a worker's legal immigration status tightly to a single sponsoring employer. This dependency limits job mobility, complicates career progression, and leaves visa holders acutely exposed to layoffs, given that losing sponsored employment can trigger a narrow window within which the worker must secure new sponsorship or depart the country.

India's expanding pool of well-funded domestic technology startups and increasingly sophisticated enterprise software companies has further widened the range of credible career options available to returning professionals, moving well beyond the traditional binary choice between staying abroad indefinitely or returning to a comparatively narrower Indian job market that characterised earlier waves of reverse migration in previous decades.
